Trial Period
You access and use this form at your own risk
By using this form, you are not creating a lawyer / client relationship with FairPlay Legal Ltd
Any implied conditions and warranties including under the Contracts and Commercial Law Act 2017 are excluded

- for recreational riders and sports horse people who have agreed both a Vet Check and a Trial Period
- important time-frame clauses depending which comes first, the Vet Check or the Trial Period. Order is your choice dependant on your circumstances
- proves the Sellers right to sell
- defines liability for risk between payment and picking up
- price promises but no others unless specifically stated
Vet Check
- time frames & final Vet Check dates agreed (Sellers don't want the process to drag on)
- deller obligated to hold the horse until the Vet Check is done (Purchaser is not at risk of losing the horse)
- a possible re-inspection allowed if initial Vet Check is ambiguous
- vet Check fee sharing options given
- ownership of the Vet Report covered
- if no Vet Check is done, Purchaser has to cancel the Agreement in writing
- with a Vet Check, the Purchaser receives the excellent information in the Owners Statement about the horse ( disease, lameness, accidents, vices, abnormalities, surgery, medications, head-shaking, and staggers)
Trial Period
- covers horse care, riding rules, & trial time-frames
- if the horse is injured or dies during the trial, what happens? This is included
- insurance options are given
- terms on refund of price or deposit if the sale falls over
- a Sellers' right to register a Security Interest so the horse isn't taken by the Purchasers creditors
